1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of flintedgestone.com (the "Site") and any purchase of materials, delivery services, quotes, or other services offered by FlintEdge Stone LLC ("FlintEdge," "we," "our," or "us").

By accessing the Site, creating an account, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or services.

These Terms are part of (and incorporate by reference) our Privacy Policy, Cookie Policy, Delivery Policy, and Sales & Cancellation Policy.

2. Eligibility, Authority, and Accounts

• You must be at least 18 years old to place an order.
• If you are purchasing on behalf of a business or organization, you represent you have authority to bind that entity to these Terms.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You agree to provide accurate, current information and to update it when it changes.

3. Products and Natural Variations

We sell bulk landscaping stone, river rock, gravel, crushed stone, sand, and aggregate ("Materials"). Materials are natural and can vary in color, size distribution, and appearance. Product photos are examples only; delivered material may differ.

Product names, gradations, and specifications are provided for convenience and may change based on quarry supply. If you need a strict gradation or DOT spec, request a quote and confirm the spec requirements before ordering.

4. Pricing, Quotes, and Payment

• Prices are shown in USD and are typically quoted per ton.
• Material and delivery pricing can vary by supply point, distance, and minimum order requirements.
• Taxes, fees, and other charges may apply based on location and applicable law.
• If we discover an error in pricing, availability, or shipping capability, we may cancel the order and refund you, or contact you with options before scheduling delivery.

Payment

• For quote requests, payment terms are confirmed in writing before scheduling.
• If online payment is enabled for an accepted order, we use Stripe as our payment processor. We do not store full payment card numbers on our servers.
• Orders are not scheduled until the order is accepted and any required payment or deposit is verified.

5. Orders, Delivery, and Customer Responsibilities

Order Acceptance

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including product availability, unsafe/inaccessible delivery locations, suspected fraud, or pricing errors.

Delivery Area and Scheduling

• Service areas vary by product and supply point. If your area is not supported by ZIP pricing or the quote flow, contact us for a quote.
• Delivery dates and times are estimates and are not guaranteed.
• Weather, road conditions, equipment issues, and supply constraints can impact delivery timing.

Access, Placement, and Safety

• You are responsible for ensuring safe access for a heavy dump truck (up to ~80,000 lbs gross weight, depending on equipment and load).
• You must clearly identify the dump location and disclose hazards (soft ground, underground utilities, sprinklers, septic systems, low wires, narrow gates, steep grades, etc.).
• The driver may refuse to enter areas that appear unsafe or likely to cause damage. In that case, delivery may be made at the safest available location (e.g., curbside) or rescheduled.
• For safety and operational reasons, dumped material typically cannot be reloaded once released. Verify product and placement direction before dumping.
• Keep people and pets away from the delivery area during unloading.

Minimum Orders

Product Minimum: Each product has a 12-ton minimum order requirement. This ensures efficient delivery and helps keep delivered cost per ton competitive.

Delivery Minimum: A minimum delivery fee of $150 applies to all orders. Larger loads provide more cost-efficient delivery per ton due to our per-truck capacity (up to ~26 tons per truckload).

6. Cancellations, Refunds, and Issues

Bulk materials are generally final sale once delivered and dumped due to the nature of the product and logistics.

• Before dispatch/loading: You may request cancellation for a full refund.
• After dispatch/loading: Cancellations may require a fee to cover loading, carrier, and/or travel costs.
• After delivery: No returns or refunds, except as required by law.
• Problems with an order: If you believe we delivered the wrong product or a material shortage, notify us within 24 hours of delivery and provide photos. We will work with you on an appropriate resolution (e.g., replacement delivery, credit, or refund) at our discretion.
• Natural variation in color/size and minor contamination typical of bulk aggregates are not considered defects.

7. Quote-Only Materials and Custom Quotes

Products, supply points, or delivery lanes may be offered as quote-only. Quote-only pricing and availability may depend on jobsite access, quantity, schedule, and spec requirements. Quotes may include terms such as validity period, minimum loads, and lead times.

8. Communications (Email & SMS)

By providing contact information, you consent to receive transactional communications about your account, quotes, and orders (including by email or SMS, where available). Marketing messages are sent only where permitted and, when required, with your consent. Message and data rates may apply.

9. Acceptable Use

You agree not to:

• Use the Site for unlawful purposes or to violate any applicable laws.
• Attempt to interfere with, compromise, or bypass Site security or access controls.
• Scrape, crawl, or harvest data from the Site without our written permission.
• Upload malware or engage in abusive, fraudulent, or deceptive activity.

10. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of FlintEdge Stone LLC or its content suppliers and is protected by copyright and intellectual property laws.

11. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Site and materials are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, FlintEdge Stone LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to your use of the Site or purchase/use of materials.

Our total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.

12. Indemnification

You agree to indemnify and hold FlintEdge Stone LLC, its officers, directors, employees, and agents harmless from any claims, losses, or damages arising from your use of our services or violation of these terms.

13. Dispute Resolution

Please contact us first so we can try to resolve issues informally. If we cannot resolve a dispute, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or an order will be resolved by binding arbitration on an individual basis, to the extent permitted by law, in accordance with the rules of the American Arbitration Association.

Class action waiver: To the extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

This section does not prevent either party from seeking relief in small claims court (if eligible) or seeking injunctive relief to protect intellectual property or confidential information.

14. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Where arbitration is not permitted or required, you agree to exclusive jurisdiction and venue in state or federal courts located in Kansas.

15. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use constitutes acceptance of modified terms.
